Terms of Sale for Buyers (Public Offer)

1. Who sells

1.1. The seller under the sale contract is IE Kristine Ghukasyan, TIN 26811509, ք. Երևան, Կենտրոն, Մարտի 8-ի փ., տ. 34, 0070 (Ереван, Кентрон, ул. 8 Марта, д. 34) (the "Platform"). The Platform sells goods in its own name under commission agency agreements with their owners — Armenian companies and individual entrepreneurs (the "Partners"). The Partner's name is shown on each product page.

1.2. A product description on arko.am with a stated price is a public offer (Articles 453 and 510 of the Civil Code of the Republic of Armenia).

2. Orders

2.1. The sale contract is concluded when the order is confirmed on the website. Orders may be placed without registration.

2.2. The price is fixed when the order is placed and does not change afterwards. Prices are in Armenian drams and include all taxes. The delivery cost is shown before the order is confirmed.

2.3. By placing an order the buyer confirms having read these terms and the Personal Data Policy.

3. Delivery and storage

3.1. Goods are delivered to the pick-up point chosen by the buyer. The delivery time is shown when the order is placed.

3.2. An order is kept at the pick-up point for 5 calendar days after arrival. An uncollected order is returned, the contract is deemed terminated and any prepayment is refunded in full.

3.3. An order may be fulfilled from goods already held at the pick-up point in the seller's factory or sealed packaging that has not been opened since dispatch (for example, after another buyer refused them without opening the packaging). Such goods have not been used; the buyer keeps all rights under sections 5–7.

4. Payment

4.1. Payment is made on collection in cash or by bank card. The buyer receives a cash register receipt in accordance with Armenian law.

5. Inspection on collection

5.1. At the pick-up point the buyer may inspect and try on the goods and refuse them, fully or partly, free of charge.

6. 14-day right of withdrawal

6.1. The buyer may withdraw from a distance contract without giving reasons within 14 calendar days of receiving the goods.

6.2. To withdraw, it is enough to request a return in the personal account, at a pick-up point, or by writing to [email protected]. Goods are returned via a pick-up point.

6.3. The money is refunded by the same payment method no later than 14 calendar days after the withdrawal notice is received; the Platform may withhold the refund until it has received the goods back.

6.4. The buyer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

6.5. The right of withdrawal does not apply to goods listed as exceptions in consumer protection legislation (including goods made to the buyer's specifications, perishable goods, and sealed goods unsealed after delivery that are unsuitable for return for hygiene reasons), where such exceptions are established by law.

7. Warranty and non-conforming goods

7.1. New goods carry a warranty of at least two years and used goods at least one year, unless otherwise provided by law.

7.2. If the goods are found not to conform during the warranty period, the buyer may, within two months of discovery, demand free repair, replacement with similar goods, a proportionate price reduction, or termination of the contract and a refund.

7.3. Repairs are carried out within 20 days and replacement within 7 days (extendable to 20 days with notice to the buyer). Claims are accepted at pick-up points or at [email protected].

8. Reviews

8.1. Reviews may only be left for goods received. The Platform may hide reviews containing insults, advertising or personal data.

9. Claims and disputes

9.1. Claims should be sent to [email protected]. We respond within 10 business days.

9.2. The buyer may apply to the Competition and Consumer Protection Commission of the Republic of Armenia or to the courts.

9.3. These terms are governed by the law of the Republic of Armenia. In case of discrepancy between language versions, the Armenian text prevails.
